La irrupción de la IA en el proceso judicial español: de la actualidad a la oportunidad y sus riesgos

Abstract

El presente Trabajo de Fin de Grado intenta ofrecer a quien lo lea una noción acerca de la revolución que la Inteligencia artificial (IA) puede realizar en entorno judicial españo, y más concretamente en el proceso judicial. Por esto, se encuentra dividido, fundamentalmente, en 3 partes diferentes. La primera parte trata acerca de las actuales herramientas y proyectos de IA que se utilizan actualmente en España. Por ello, se describen las principales herramientas, como RISCANVI, VioGen, la cancelación automática de antecedentes penales o el anonimizador documental. Posteriormente, dentro de ese primer punto, se describen los diferentes esfuerzos regulatorios, tanto nacionales como supranacionales que afectan al proceso judicial español; en tanto en cuanto afectan al ordenamiento jurídico español. En este punto también se examinan los proyectos presentados por el Consejo de Ministros en torno a la IA, y la influencia del Reglamento de la UE sobre el uso de la IA. Posteriormente, en el segundo punto, se realiza una sucinta visión al futuro de la IA como (im)posible juzgador y como herramienta de apoyo a la jurisdicción, fundamentado sobre las últimas investigaciones. El último punto es una advertencia a la posible amenaza que la IA puede ser frente al debido proceso, en concreto a la presunción de inocencia, el derecho a la defensa, y al juez natural e imparcial. Asimismo, se tratará de dar respuesta a los principios que se deberían englobar dentro de un proceso judicial con IA para poder mantener este derecho fundamental. Por último, hay una breve conclusión para que esta ´´lucha de juristas´´ no se pierda nunca.

The present Final Degree Project aims to offer the reader an overview of the revolution that Aritifical Inteligence (AI) can bring about in the Spanish judicial environment, and more specifically in the judicial process. For this reason, it is fundamentally divided into three different parts. The first part deals with the current AI tools and projects that are presently used in Spain. Accordingly, the main tools are describes, such as RISCANVI, VioGen, the automatic cancellation of criminal recors, ord the document anonymizer. Subsequently, within the first section, the different regulatory efforts are describes, both national and supranational, that affect the Spanish judicial process insofar as they impact the Spanish legal system. At this point, the AI-related project that have been presented by the Council of Ministers are examined, as well as the influence of the EU Regulation on the use of AI. Subsequently, in the second section, a concise view of the future of AI as a (im)possible judge and as support tool for the judiciary is provided, based on the latest research. The final section is a warning about the possible threat that AI may pose to due process, specifically to the presumption of innocence, the right to defence, and the right to a natural and impartial judge. Likewise, an attempt is made to provide answers regarding the principles that should be encomapassed within a judicial process involving AI in order to preserve this fundamental right. Finally, there is a brief conclusion so that this ´´struggle of jurists´´ is never lost.
