Abstract

Este capítulo examina la figura de Atticus Finch en Matar a un ruiseñor (Harper Lee, 1960) como modelo de abogacía ética y de compromiso humano frente a la injusticia social y racial. La autora sitúa la obra en su contexto histórico y literario, analiza los personajes principales y secundarios, y profundiza en los grandes temas humanos que laten en la novela: racismo, segregación, discriminación social, educación en valores y pérdida de la inocencia. En particular, se estudia la dimensión procesal y jurídica del juicio a Tom Robinson, abordando aspectos como el derecho a la defensa letrada, la actividad probatoria, la presunción de inocencia, el in dubio pro reo y la función del jurado. La investigación concluye que Atticus Finch constituye un referente ético y profesional que trasciende el marco estadounidense, al encarnar la integridad, la justicia y la empatía, y al mostrar que el ejercicio de la abogacía puede y debe orientarse al bien común.

This chapter explores the figure of Atticus Finch in To Kill a Mockingbird (Harper Lee, 1960) as a paradigm of ethical lawyering and human commitment in the face of social and racial injustice. The author contextualizes the novel, examines its main and secondary characters, and addresses the major human themes embedded in the narrative: racism, segregation, social discrimination, education in values, and the loss of innocence. Special attention is given to the legal and procedural aspects of Tom Robinson’s trial, including the right to legal counsel, evidentiary standards, the presumption of innocence, the principle of in dubio pro reo, and the jury’s role. The study concludes that Atticus Finch stands as an ethical and professional benchmark that transcends the American context, embodying integrity, justice, and empathy, and demonstrating how the practice of law can and should serve the common good.
