Particularidades del proceso penal español a tenor de su idiosincrasia cultural: Análisis de la figura del juez de instrucción

Abstract

El presente trabajo aborda la fase de instrucción en el proceso penal español, deteniéndose en el juez de instrucción y su importancia histórica. El trabajo revisa las funciones del juez de instrucción y plantea la posibilidad de atribuirle dichas funciones a la fiscalía —tal como sucede en otros sistemas jurídicos cercanos-. El análisis del rol que cumple el juez instructor deja entrever lo arraigada que está la figura en la idiosincrasia española y se examinan las reformas que deberían llevarse a cabo en caso de pretender abolirla.

This paper addresses the investigation phase in Spanish criminal proceedings, focusing on the investigating judge and his historical importance. The functions of the investigating judge are examined through the paper, focusing on the possibility of giving these functions to the prosecution —as it is common in other legal systems-. The analysis of the role played by the investigating judge reveals how deeply rooted the figure is within the Spanish idiosyncrasy. The paper also tackles the amount of reforms that should be carried out in order to abolish the figure.
