Derechos Humanos y ESG. Los derechos humanos en el ámbito de la empresa

Abstract

Este capítulo analiza la relación entre los derechos humanos y los criterios ESG en el ámbito empresarial, destacando el cambio de un enfoque tradicionalmente vertical —centrado en el Estado como principal garante de los derechos— hacia una concepción horizontal que incorpora a las empresas como actores clave. El autor examina la evolución desde la responsabilidad social corporativa hasta los principios ESG, subrayando el papel de los Principios Rectores de Naciones Unidas sobre Empresas y Derechos Humanos y su conexión con la Agenda 2030. Se estudian las obligaciones del Estado de proteger, la responsabilidad empresarial de respetar los derechos y la necesidad de mecanismos de reparación efectivos. Asimismo, se reflexiona críticamente sobre los riesgos de prácticas como el greenwashing y el human rights-washing. El capítulo concluye que los principios ESG pueden constituir nuevas garantías para la protección de los derechos humanos, siempre que se integren de forma real, coherente y verificable en la estrategia empresarial.

This chapter examines the relationship between human rights and ESG criteria in the business sphere, highlighting the shift from a traditionally vertical approach —focused on the State as the main guarantor of rights— to a horizontal conception that includes companies as key actors. The author analyses the evolution from corporate social responsibility to ESG principles, emphasizing the role of the United Nations Guiding Principles on Business and Human Rights and their connection with the 2030 Agenda. The chapter explores the State’s duty to protect, corporate responsibility to respect human rights, and the need for effective remedies. It also critically reflects on the risks of practices such as greenwashing and human rights-washing. The chapter concludes that ESG principles can become new guarantees for the protection of human rights, provided they are genuinely, coherently, and verifiably integrated into corporate strategies.
