La justicia restaurativa en el Derecho Canónico.

Abstract

Este capítulo examina la justicia restaurativa en el derecho canónico, especialmente en relación con los abusos en contextos eclesiales. La autora sostiene que los procedimientos penales canónicos necesitan repensarse para responder de forma real a las necesidades de las víctimas y también de los victimarios, evitando que la protección institucional prevalezca sobre la verdad y la justicia. A partir de la tradición jurídica de la Iglesia, identifica mecanismos e institutos canónicos que permiten orientar la respuesta penal hacia la dignidad de las personas, la reconciliación y la reparación del daño. El texto propone, así, una lectura del derecho canónico capaz de integrar elementos restaurativos y de ofrecer vías más humanas y eclesialmente coherentes para afrontar los abusos.

This chapter examines restorative justice in Canon Law, especially in relation to abuses committed in ecclesial contexts. The author argues that canonical criminal proceedings need to be rethought so that they truly respond to the needs of victims as well as perpetrators, instead of allowing institutional self-protection to prevail over truth and justice. Drawing on the Church’s legal tradition, she identifies canonical mechanisms and juridical institutes that can orient penal responses toward personal dignity, reconciliation, and reparation. The chapter therefore proposes an interpretation of Canon Law that is capable of integrating restorative elements and offering more humane and ecclesially coherent ways of addressing abuse and its consequences within the life of the Church.
