Entre la historia y la historiografía. Del primer constitucionalismo hispánico a la construcción del Estado nación

Abstract

La historia del constitucionalismo de España y del mundo hispánico se ha abordado desde la historiografía constitucional con una perspectiva centrada en lo nacional, las comparaciones o la politización del constitucionalismo del siglo XIX. Estas aproximaciones han impedido dar cuenta de la complejidad de los procesos constituyentes y de todo un aparato que se relacionaba con los textos constitucionales y del sentido de esas interacciones. Este estudio busca superar estos marcos reduccionistas y ofrece una visión que no se limita a los textos y sus características, sino que sitúa la constitución en su contexto jurídico-cultural y presta atención a otros cambios “constitucionales”, como la formación del Estado-nación.

The history of constitutionalism in Spain and the Hispanic world has been approached by constitutional historiography from a perspective focused on nationalism, comparisons, or the politicization of 19th-century constitutionalism. These approaches have failed to account for the complexity of constituent processes and the broader framework connected to constitutional texts and the meaning of those interactions. This study seeks to overcome these reductionist frameworks and offers a perspective that goes beyond texts and their characteristics, situating the constitution within its legal-cultural context and addressing other “constitutional” changes, such as the formation of the nation-state.
