Sobre la tópica jurídica en Viehweg

Abstract

El presente artículo realiza una aproximación a la tópica jurídica desde Theodor Viehweg con el objeto de reivindicar su contribución a la ciencia del derecho. Se estudian los fundamentos de la tópica jurídica a través de su desarrollo en Aristóteles, Cicerón y Vico, así como su pervivencia desde el ius civile y el mos italicus hasta la moderna doctrina civilista. Por otro lado, se ofrece una panorámica de las principales críticas recibidas por el pensamiento tópico por parte de la metodología sistemática y formalista. Se concluirá la reflexión abriendo el debate sobre la pérdida de vigencia del método tópico y su relación con la aporía fundamental de la justicia, el Estado moderno y la práctica del derecho.

This article is an approach to the legal topics of Theodor Viehweg in order to vindicate his contribution to the jurisprudence. Therefore, we study the basics of the legal topics through its development in Aristotle, Cicero and Vico, and its survival from the ius civile and mos italicus to modern civil doctrine. On the other hand, this article provides an overview of the main criticism against legal topics by the systematic and formalist methodologies. Our reflection will conclude by opening a debate on the loss of relevance of legal topics and its relation to the fundamental problem of justice, the role of modern State and the practice of law.
