Acerca del legado jurídico y social de D. Francisco Giner de los Ríos

Abstract

Este ensayo analiza el importante y enjundioso libro de la profesora Delia María Manzanero Fernández, "El legado jurídico y social de Giner", situándolo en la herencia intelectual, de Enrique Menéndez Ureña. A lo largo de sus páginas va desentrañando las claves de lectura de las tres partes que lo componen: la recuperación de los clásicos hispanos pertenecientes al pensamiento liberal krausista; la filosofía social krausista; y la filosofía jurídica gineriana, destacando algunos rasgos fundamentales del concepto de Derecho de Giner, como la actualidad del método interpretativo de la epiqueya y la fertilidad del concepto de corpus mysticum y su relación con el análisis krausista de la naturaleza de la sociedad.

This essay analyzes the important and seminal book of Professor Delia Maria Manzanero Fernandez, El legado jurídico y social de Giner , placing it at the intellectual inheritance, Enrique Menéndez Ureña. Throughout its pages will unravel the keys of reading of the three parties that compose it: the recovery of belonging to the liberal krausist thought Hispanic classics, establishing its relationship with contemporary thought; the krausist social philosophy; and legal philosophy gineriana, highlighting some fundamental features of the concept of right of Giner, as today's interpretation of the epieikeia method and the fertility of the concept of corpus mysticum and its relationship with the krausist analysis of the nature of the society.
