Reflexiones en torno a las modificaciones de la Ley Orgánica del Tribunal Constitucional

Abstract

El Boletín Oficial del Estado publicó el 25 de mayo, la Ley Orgánica 6/2007, de modificación de la Ley Orgánica 2/1979, de 3 de octubre del Tribunal Constitucional. La actual reforma pretende abordar algunos temas abiertos de la normativa y especialmente solucionar las dificultades de funcionamiento del Tribunal Constitucional. Desde su creación, el funcionamiento del Tribunal ha ido paulatinamente expresando ciertas dificultades, sobre todo de ámbito procedimental, que obstaculizan el ejercicio de las funciones que la Constitución le otorga como garante supremo del ordenamiento jurídico. Objetivo del presente estudio es analizar el alcance de la última reforma partiendo de un breve análisis de las competencias que se confieren a nuestro Tribunal.

The Official Bulletin of the State published the 25 of May, the organic law 6/2007, of modification of organic law 2/1979, of 3 of October of the Constitutional Court. The present reform tries to approach some opened subjects of the norm and specially to solve the difficulties of operation of the Constitutional Court. From its creation, the operation of the Court has gone gradually expressing certain difficulties, mainly of procedural scope, that prevent the exercise of the functions that the Constitution grants to him like supreme guarantor of the legal ordering. Objective of this study is to analyze the reach of the last reform being started off a brief analysis of the competitions that confer our Court.
