Capacidad del menor y tratamiento médico

Abstract

El extraordinario avance en las últimas décadas de la Medicina y en general de las Ciencias de la Vida ha provocado la aparición de nuevos dilemas y conflictos que atañen muy directamente a los derechos y libertades de las personas, habiéndose, incluso, propuesto ya una nueva categoría de derechos desde la perspectiva de su evolución histórica, los derechos de cuarta generación, los cuales estarían presididos por la incertidumbre que genera la mencionada evolución científica y tecnológica. Entre estos nuevos derechos y libertades destacan como protagonistas principales el derecho a autorizar o rechazar cualquier intervención médica, previo un proceso de información, o lo que también se conoce, aunque sea de manera algo errónea, como el derecho al consentimiento informado, y el derecho a la intimidad de la información relativa a la salud de las personas, ambas expresiones en el ámbito sanitario del principio de autonomía que preside ahora la relación médico-paciente. Estas serían las más importantes y recientes aportaciones realizadas en la teoría de los derechos humanos, consecuencia necesaria o explicación de los clásicos derechos a la vida, a la integridad física y a la libertad de conciencia en el marco de la asistencia sanitaria.

he extraordinary advance in the last decades of Medicine and in general of the Life Sciences has led to the emergence of new dilemmas and conflicts that are very directly related to the rights and freedoms of people, and have even proposed a new category of rights from the perspective of its historical evolution, the rights of fourth generation, which would be presided over by the uncertainty that generates the aforementioned scientific and technological evolution. Among these new rights and freedoms, the main protagonists are the right to authorize or reject any medical intervention, prior to an information process, or what is also known, even in a somewhat wrong way, such as the right to informed consent, and the right to the intimacy of information concerning the health of people, both expressions in the health field of the principle of autonomy that now presides over the doctor-patient relationship. These would be the most important and recent contributions made in the theory of human rights, a necessary consequence or explanation of the classic rights to life, physical integrity and freedom of conscience in health care.
