La regulación jurídica se asoma a la incertidumbre tecnocientífica

Abstract

Hoy parece existir un consenso casi unánime en subrayar que no sólo es importante lo que dicen las leyes sino lo que consiguen. En un contexto de globalización económica sólo una regulación de gran calidad permite aportar beneficios a la colectividad en tanto contribuye al crecimiento económico. El incesante avance de la ciencia y de la tecnología que caracteriza a estas primeras décadas del siglo XXI dificulta sobremanera la labor del legislador. A los grandes beneficios para la humanidad del avance tecnocientífico se suman nuevos riesgos, dilemas e incógnitas que afectan sustancialmente a la toma de decisiones jurídicas. La incertidumbre que supone el avance de la ciencia dificulta la función reguladora del Derecho. Para paliar dichas dificultades se ha desarrollado un principio, en virtud del cual, no hace falta esperar a que una determinada actividad esté prevista normativamente para que pueda ser no permitida. El vacío legal derivado de la imposibilidad del Derecho de alcanzar al avance científico no permitirá que dicha ausencia pueda ser aprovechada para, invocando el principio de libertad, desarrollar una actividad que genera incertidumbre acerca de sus riesgos para las personas o el entorno.

Today there seems to be an almost unanimous consensus in emphasizing that not only what the laws say is important, but what they achieve. In a context of economic globalization, only a high quality regulation allows the community to benefit as it contributes to economic growth. The incessant advance of science and technology that characterizes these first decades of the 21st century makes the work of the legislator extremely difficult. To the great benefits for the humanity of the technoscientific advance are added new risks, dilemmas and unknowns that substantially affect the legal decision making. The uncertainty that the advancement of science implies hinders the regulatory function of Law. To alleviate these difficulties, a principle has been developed, by virtue of which, it is not necessary to wait until a certain activity is normatively planned so that it can be not allowed. The legal vacuum resulting from the impossibility of the Right to achieve scientific progress will not allow that absence can be used to, invoking the principle of freedom, develop an activity that generates uncertainty about their risks to people or the environment.
