La toma del otro, la partición del yo (equidad kantiana, derecho gineriano, melancolía freudiana)

Abstract

Arrancando el asunto con la discusión del concepto kantiano «equidad», umbral entre moral y derecho, se recorre una vía de interiorización y subjetivización de la relación jurídica que arriba al concepto «estado individual» krauso-gineriano, para, de seguido, plantear cómo la circularidad y clausura de que se reviste el imperativo ético-jurídico en la identidad subjetiva está alterado, ya de antemano, por la sombra y el eco del otro, que, lejos de conformarse en una intersubjetividad que todo lo lleva a lo mismo, se incuba como instancia ectópica y cismática en el yo, a la manera como el fracaso melancólico de la identificación supondrá la génesis del superego freudiano.

This paper starts with the discussion of the Kantian concept of "equity", a threshold between morality and law, and it walks a path of internalization and subjectivation of the juridical relationship that leads to the Krauso-Ginerian concept of «individual state». This, in order to discuss how the circularity and closure of the ethical-juridical imperative in subjective identity is altered, already from the start, by the shadow and the echo of the other, which, far from being conformed in an intersubjectivity that leads to the same thing, is incubated as an ectopic and schismatic instance in the ego, just like the melancholic failure of identification will suppose the genesis of the Freudian superego.
