La identidad del niño y el respeto a sus derechos

Abstract

En un momento de gran confusión sobre cómo actuar con los niños con disforia de género, este texto pretende contribuir a una reflexión serena sobre los derechos de estos niños desde la perspectiva de la Convención de los Derechos del Niño de 1989. Buscar el interés superior del niño en cada decisión que debe adoptarse y, por tanto, evaluar los distintos derechos implicados, atender a los criterios legales que facilitan esa evaluación y ponderar los elementos que concurren en la situación no sólo resulta conveniente, sino que se trata de un imperativo que nace del propio texto convencional.

In a moment of great confusion about how to act with children with dysphoria gender, this text aims to contribute to a serene reflection on the rights of these children from the perspective of the Convention of the Rights of the Child of 1989. Search child's best interest in every decision which must be adopted and, therefore, assess the different rights involved, attend to the legal criteria that facilitate that evaluation and ponder the elements that concur in the situation it is not only convenient, but it is an imperative that is born of the conventional text itself.
