La respuesta de la Seguridad social a los menores víctima de violencia

Abstract

La Seguridad Social viene a proteger y dar cobertura a situaciones de necesidad determinadas por la Ley que suponen para el sujeto protegido una disminución de ingresos o un incremento de gastos. Las situaciones de violencia de género conllevan riesgos personales y familiares que determinan situaciones de necesidad que han de ser protegidas. Este trabajo se centra específicamente en la respuesta de la Seguridad Social a la protección de los menores víctimas de violencia a través de las prestaciones de muerte y supervivencia, en concreto, mediante el establecimiento de restricciones a los agresores en el derecho a las prestaciones y en el incremento de las prestaciones de los menores huérfanos y se analiza si esta respuesta legal otorga cobertura real a las situaciones de necesidad de estos menores en los entornos de violencia de género.

The Social Security protects the situations of necessity that suppose for the protected subject a decrease of income or an increase of expenses. Situations of gender violence entail personal and family risks are the source of situations of need that must be protected. This work focuses on the Social Security response to the protection of child victims of violence through death and survivorship benefits, in particular, with the establishment of restrictions on offenders in the right to benefits and the increase in the benefits of orphaned minors and it is analyzed if this legal response gives real coverage to the situations of need of these minors in environments of gender violence.
