dc.description.abstract | Paradójicamente, un instituto como el de la prescripción, per se destinado a otorgar certezas al Derecho, encierra en sí mismo múltiples interrogantes y a la vez incertidumbres sobre su fundamento, su naturaleza, su objeto. Perdido en ese inevitable mito de Ariadna particular, la figura de la prescripción, tan poliédrica en sí, como polivalente funcionalmente, presenta una riqueza dogmática y práctica inconmensurable. No por ello pierde complejidad pese a su elasticidad, como tampoco por ello deja de ofrecer diversas y a veces artificiosas explicaciones dogmáticas y particulares. Desde el estatismo de algunas visiones, sin duda, una comprensión analítica y crítica de la figura es esencial. El laconismo de la LCS, con un artículo 23 sumamente ambiguo y genérico, deja abiertas las puertas a innumerables dudas y problemáticas que la riqueza práctica dirime día tras día. No toda acción deriva del contrato de seguro y, sin embargo, se acciona contra la aseguradora o el asegurado. | es-ES |
dc.description.abstract | Paradoxically, an institute such as the one of prescription, per se destined to grant certainties to the law, contains in itself multiple questions and, at the same time, uncertainties about its basis, nature and aim. Lost in the inevitable myth of Ariadna, the prescription figure, as polyhedral in itself as functionally versatile, presents a huge dogmatic and practice wealth. Nevertheless, it does not lose complexity despite its elasticity, nor does it fail to offer diverse and sometimes contrived dogmatic and particular explanations. From the immobility of some visions, undoubtedly, an analytical and critical understanding of this figure is essential. The laconicism of the Insurance Contract Law, with a very ambiguous and generic article 23, leaves the doors open to innumerable questions and problems that the practical wealth resolves every day. Not every action derives from the insurance contract and, nevertheless, it is triggered against the insurer or the insured. | en-GB |
