La expedición de Magallanes-Elcano: el inicio de la globalización del Derecho Mercantil

Abstract

En este artículo se pretende analizar cómo la expedición de Magallanes-Elcano, en la que se llevó a cabo la primera circunnavegación de la tierra, supuso el inicio de un cambio trascendental para el Derecho Mercantil español al ponerse en conexión diferentes territorios de Europa, América, Asia y África y establecerse diferentes rutas comerciales por mar. En efecto, si bien el Derecho Mercantil seguirá siendo un conjunto normativo eminentemente estatal, el viaje hará que comiencen a tenerse en cuenta factores externos y ellos supondrá el principio de la globalización que hoy en día rige el ámbito del Derecho Mercantil. Este primer paso en el cambio de paradigma jurídico afectará al Derecho Marítimo y posteriormente, con el paso de los siglos, repercutirá en toda la disciplina mercantil para configurarse un Derecho del Mercado en detrimento del Derecho Mercantil estatal.

This paper aims to analyse how the Magallanes-Elcano expedition, in which the first circumnavigation of the earth was carried out, marked the beginning of a transcendental change for Spanish Commercial Law by connecting different territories in Europe, America, Asia and Africa and establishing different trade routes by sea. Indeed, although Commercial Law will continue to be an eminently national set of rules, the journey will cause external factors to begin to be taken into account and they will represent the principle of globalisation that currently governs the field of Commercial Law. This first step in the change of legal paradigm will affect the Maritime Law and later, with the passage of the centuries, it will have repercussions in all the mercantile discipline to configure a Market Law in detriment of the state Commercial Law.
