Abstract

Se analizan las dos cuestiones jurídicas que aparecen en la sentencia del TJUE pero que no son problemáticas, la doble nacionalidad y la apatridia, desde la perspectiva del Derecho europeo. En segundo lugar, se abordan los tres problemas principales que plantea la sentencia: el concepto de nacionalidad efectiva , y la compatibilidad de la normativa neerlandesa en su vertiente procesal y sustantiva con el Derecho europeo. Finalmente, se menciona la regulación que de estos casos hace el Derecho español de nacionalidad.

The work analizes the different questions that the Judgerment of the ECJ poses: the double nationality and the apatridie, the concept of effective nationality and the compatibility of the laws of The Netherlands, either in the substantive provisions or in the procesual ones, with the european law. Finally the aythor analizes the impact of this judgement in the spanish nationality law
