Climate Change and Public Law: Some Interactions and Challenges

Abstract

El cambio climático plantea desafíos relevantes al Derecho Público, muchos de los cuales tienen relevancia constitucional. En este capítulo, analizaremos cómo el cambio climático afecta la definición de varios derechos y principios constitucionales. También exploraremos cómo las autoridades públicas pueden proteger algunos de estos derechos, con una referencia particular a los incentivos públicos. Además, destacaremos la importancia de distribuir correctamente las competencias y responsabilidades entre las distintas entidades territoriales para hacer frente al cambio climático. Finalmente, nos ocuparemos de la reacción adecuada a las infracciones más graves de las regulaciones clave dentro de la política de mitigación del cambio climático y argumentaremos que el castigo penal no debe jugar un papel a este respecto.

Climate change poses relevant challenges to Public Law, many of which have constitutional relevance. In this chapter, we will analyze how climate change affects the definition of several constitutional rights and principles. We will also explore how public authorities can protect some of these rights, with a particular reference to public incentives. Moreover, we will stress the importance of correctly distributing powers and liabilities between different territorial entities to face climate change. Finally, we will deal with the appropriate reaction to the more serious infringements of the key regulations within the policy of climate change mitigation and argue that criminal punishment should not play a part in this respect.
