Abstract

En este libro se recogen alguna de las investigaciones que se han desarrollado en el marco del Proyecto de Investigación “Historia de los Derechos de las Mujeres en el siglo XX”. En la reflexión contemporánea sobre los derechos, la discusión sobre la posición jurídica de las mujeres en el seno del discurso iusfundamental ha ido cobrando cada vez más relevancia. Son diversas las razones que pueden explicar esa relevancia. Junto a determinados elementos sociales y políticos, la elaboración de una fundamentación específica ha colaborado en la justificación de los derechos de las mujeres. En este sentido, al feminismo (en sus diversas vertientes y manifestaciones) le corresponde la importante responsabilidad no sólo de haber removido algunas conciencias y mostrado dimensiones de evidente injusticia, sino también la de haber renovado el discurso fundamentador de los derechos… El libro recoge un conjunto de aportaciones que, abordando críticamente algunas dimensiones de la perspectiva feminista, reconocen su valor no sólo a la hora de desenmascarar las situaciones de discriminación que han sufrido las mujeres, sino también a la de plantear de manera problemática algunos aspectos de tradicional discurso jurídico y, en particular, del discurso de los derechos.

This book collects some of the research that has been developed within the framework of the Research Project "History of Women's Rights in the 20th century." In contemporary reflection on rights, the discussion on the legal position of women within the fundamental ius discourse has been gaining more and more relevance. There are several reasons that can explain this relevance. Along with certain social and political elements, the development of a specific foundation has contributed to the justification of women's rights. In this sense, feminism (in its various aspects and manifestations) has the important responsibility not only to have stirred some consciences and shown dimensions of evident injustice, but also to have renewed the foundational discourse of rights ... The book includes a A set of contributions that, critically addressing some dimensions of the feminist perspective, recognize their value not only in unmasking the situations of discrimination that women have suffered, but also in posing in a problematic way some aspects of traditional legal discourse and , in particular, of the discourse of rights.
