Competencia Judicial Internacional en el contrato de transporte marítimo de mercancías : con referencia al impacto del Brexit

Abstract

Este trabajo tiene por objeto el estudio y valoración critica de la competencia judicial internacional en el contrato marítimo de mercancías, y las distintas cuestiones y problemáticas que surgen al respecto. Se analiza, entre otros asuntos, los criterios seguidos por los principales bloques normativos aplicables y su ponderación de intereses de las partes del contrato de transporte marítimo, las cláusulas de jurisdicción, la compatibilidad de la Ley de Navegación Marítima con el Derecho Europeo y la doctrina más relevante al respecto. Por último, se evalúa el impacto que ha tenido el Brexit sobre los tribunales de Londres, foro de referencia en el Derecho Marítimo.

The purpose of this work is to study and critically assess the international jurisdiction in the maritime contract of carriage of goods, and the different questions and problems that arise in this respect. It analyses, among other issues, the criteria followed by the main applicable regulatory blocks and their weighting of the interests of the parties to the maritime transport contract, the jurisdiction clauses, the compatibility of the Maritime Navigation Law with European Law and the most relevant doctrine in this regard. Finally, the impact that Brexit has had on the London courts, a reference forum in Maritime Law, is assessed.
