Respeto a los derechos fundamentales de los religiosos: propuestas pastorales y sugerencias "de iure condendo"

Abstract

Los derechos de todos los fieles en la Iglesia es un patrimonio que el Vaticano II y el Código del 83 han recogido y refrendado. En este trabajo revisamos dichos derechos respecto a los religiosos, ya que percibimos carencias en su concreción, fundamentadas casi siempre en el voto de obediencia que profesan y en las relaciones superiores/súbditos que en los institutos religiosos se dan. Presentamos los cánones del CIC que creemos que dificultan la asimilación de los religiosos a los demás fieles en cuanto a la vivencia de sus derechos en la Iglesia, sobre todo el que contiene el voto de obediencia, así como los que consideramos más positivos en este sentido. A continuación, aplicamos diversos derechos de los fieles a la problemática particular que percibimos en la vida religiosa y acabamos presentando unas sugerencias de iure condendo de cara a preservar mejor dichos derechos en futuras reformas legislativas.

The rights of all the faithful in the Church are a patrimony assumed and endorsed by Vatican II and the 1983 Code. In this paper we review these rights in the case of those belonging to religious institutes. There are deficiencies in their concreteness, based mainly on the vow of obedience that religious profess as well as on the superior/subject relationships existing in religious institutes. We present the canons of the CCL that we believe make it difficult for the religious to be assimilated into the rest of the faithful in terms of living out their rights in the Church. We focus on the canon containing the vow of obedience, as well as on those that we consider to be more positive in this regard. Then we apply various rights of the faithful to the particular problems we perceive in religious life and we conclude by presenting some de iure condendo suggestions in order to better preserve these rights in future legislative reforms.
