Intervención farmacológica en menores de edad con problemas de conducta

Abstract

el menor es ya sujeto activo en relación al tratamiento médico, disponiendo de la facultad de ser escuchado cuando tenga madurez suficiente y, en todo caso, a partir de los 12 años de edad, y el derecho a autorizar o rechazar el tratamiento médico a partir de los dieciséis años o, incluso, antes (criterio subjetivo) cuando se aprecie en él madurez suficiente para tomar la decisión, aunque con una serie de límites importantes, sobre todo, cuando la correspondiente negativa a tratarse suponga un grave riesgo para su salud física o psíquica. Así pues, el menor de dieciséis o más años está capacitado para rechazar un tratamiento médico salvo que opere la excepción que habrá que concretar en cada caso, evaluando los riesgos concretos de la falta de aplicación del tratamiento.
