The Trafficking of Children for the Purpose of Sexual Exploitation in Spain

Abstract

La trata de niños con fines de explotación sexual es, sin lugar a dudas, la mayor vulneración de derechos de los menores que podemos encontrar y una de las peores formas de malos tratos y explotación que los niños pueden sufrir en este mundo. Según datos de Eurostat el 23% de las víctimas de trata con fines de explotación sexual en Europa son niñas y niños (European Comissión, 2018), sin embargo, el número de niñas/os víctimas de trata identificados en España es muy bajo. Eso no significa que no existan niños/as objeto de trata en nuestro país, sino que lo que demuestra es que no estamos siendo capaces de identificarles de una forma adecuada. Lo que sí sabemos es que estos datos están aumentando cada año de forma preocupante. Cada día hay más niñas/os que son utilizados por las redes de trata de personas para ser explotados sexualmente.

Es importante que sepamos por qué las niñas/os son tan interesantes para las redes de trata. Para poder identificar a las víctimas tenemos que saber de qué manera las mafias utilizan a estos menores e intentar ver dónde pueden ubicarles para sus fines de explotación sexual.

Por supuesto será fundamental la labor e intervención tanto del Estado como de los organismos públicos en el proceso de identificación y protección de los menores, así como los procedimientos empleados para la identificación de las posibles víctimas. La pregunta que debemos hacernos es si sería posible mejorar estos mecanismos para ser más eficaces en la detección. Y una vez identificados, ¿los mecanismos de protección y de recuperación que empleamos en España están cumpliendo su función? ¿Los recursos que se les ofrecen son realmente adecuados para su efectiva protección?

The trafficking of children for the purpose of sexual exploitation is, undoubtedly, the greatest rights violation of minors that exists and one of the worst forms of abuse and exploitation that children can suffer in this world. According to the data from Eurostat, 23% of the victims of trafficking for the purpose of sexual exploitation in Europe are girls and boys (European Commission, 2018). However, the number of children who are identified as victims of trafficking in Spain is very low. That does not mean that there are not any children who have been the object of trafficking in this country, rather that we have not been capable of identifying them adequately. What we do know is that these data are increasing every year in an alarming fashion. Every day, more children are being used by the human trafficking networks to be sexually exploited.

It is vital that we learn why boys and girls are so attractive for the trafficking networks. To be able to identify the victims, we have to learn the ways in which organized crime is using these minors and to try to see where they can place them for the purpose of sexual exploitation.

The work and intervention of both the state and public bodies is of course essential in the process of identification and protection of possible underage victims. The question we must ask is whether it is possible to improve these mechanisms in order to be more efficient at detection. And once identified, are the protection and recovery mechanisms that are used in Spain fulfilling their function? Are the resources that the victims are offered really adequate for their effective protection?
