El mal llamado «derecho al olvido» en la era de Internet

Abstract

La sentencia del TJUE de 13 de mayo de 2014 ha recibido una gran atención mediática al reconocer la existencia del «derecho al olvido». Este artículo analiza en qué consiste verdaderamente este derecho, cómo afecta a la libertad de expresión y de información, y qué criterios deben seguirse a la hora de realizar una adecuada ponderación de derechos, así como qué consecuencias negativas puede conllevar el reconocimiento de un derecho al olvido frente a los gestores de motores de búsqueda.

The ECJ judgment of May 13, 2014 has received a great deal of media attention because it recognizes the “right to be forgotten”. This article analyzes what this right means, how it affects freedom of expression and freedom of information, and which criteria must be followed to balance appropiately the opposing rights, as well as the negative consequences that may entail the recognition of the right to be forgotten against the operators of search engines
