Loans concluded in a foreign currency - their main subject matter and the transparency requirement

Abstract

Este trabajo analiza dos cuestiones que, versando sobre los contratos de crédito celebrados en moneda extranjera, son de especial importancia en la relación entre empresarios y consumidores. Estos son la noción de objeto principal del contrato, por un lado, y la exigencia de transparencia de las cláusulas contractuales, por el otro. El estudio incluye comentarios generales sobre cada uno de estos puntos, prestando especial atención a la sentencia del Tribunal de Justicia de la Unión Europea Andriciuc y otros y a la sentencia del Tribunal Supremo español de 15 de noviembre de 2017".

"This paper analyzes two issues that, concerning credit agreements concluded in a foreign currency, are of special importance in the relationship between businesses and consumers. These are the notion of main subject matter of the contract, on the one hand, and the requirement of transparency of contractual clauses, on the other.
