Der Prozess (1925), de Franz Kafka, como contraejemplo para juristas

Abstract

Se aborda el estudio de El proceso (1925), de Franz Kafka (1883-1924), desde una perspectiva fundamentalmente jurídica. El método escogido consiste en seleccionar unos fragmentos de la obra, siguiendo el curso de los diez capítulos que conforman la misma, para explorar qué contraejemplos pueden resultar de utilidad (léase reflexión) para los juristas. Antes de llevar a cabo dicho rastreo, se introducen el autor y la obra de referencia, reparando, por una parte, en la condición de jurista de Kakfa y en los antecedentes y la génesis de El proceso y, por otra, en el argumento y en las diversas interpretaciones a que ha dado lugar la obra en cuestión. Tras los contraejemplos, se resalta el carácter de Contramanual de Derecho que puede atribuirse a la obra kafkiana.

The study of The Trial (1925), by Franz Kafka (1883-1924), is approached from a primarily legal perspective. The method that is chosen consists of selecting fragments of the work, following the course of the ten chapters that make up the work, in order to explore which counterexamples may be useful (i.e reflection) for jurists. Before doing so, the author and the work of reference are introduced by examining, on the one hand, Kakfa's status as a jurist and the background and genesis of The Trial and, on the other, the plot and the various interpretations to which the work in question has given rise. After the counterexamples, the character of the Counter-manual of Law that can be attributed to the Kafkaesque work is highlighted.
