Abstract

Hace ya tres décadas, un libro, aparentemente sencillo, escrito con la donosura del lenguaje jurídico y léxico que solo los grandes maestros son capaces, revolucionó el mundo del derecho de garantías, sobre todo, mobiliarias. Nuevo, vibrante, hoy diríamos, disruptivo. Valiente y que analizaba y rompía viejos moldes tensionando las costuras de una institución tan secular como clave en el derecho, la prenda. El derecho real de prenda. No solo en Italia, también en otros países, de la que han dado buena cuenta las innumerables, primero, reseñas o recensiones que expertos académicos -todos ellos estudiosos de las garantías-, hicieron de esta monografía, y segundo, las referencias, el estudio sosegado y minucioso de cada parte, de cada apartado y línea de un libro, simplemente, descomunal. Obra, además, de juventud del profesor Gabrielli y que, hoy, treinta y tres años después de su primera aparición pública, sigue siendo y estando viva, rabiosamente viva. Un libro ya, al tiempo de publicarse, llamado a ser clásico entre los clásicos y obra de referencia. Y no han sido pocas ni pequeñas las reformas de calado que han surgido en el país trasalpino a lo largo de estos años entorno a la prenda, significativamente en 2016 y 2020. Se puede decir -sin miedo a equívocos- que este libro marca un punto de inflexión en cómo abordar, ver, comprender e incluso, imaginar, la prenda. Un punto que rompe los rígidos esquemas estructurales, pero también, mentales, amén de encorsetamientos formales que la garantía exigía en las normas. Un libro donde, además, se lleva un amplio o vasto análisis de la causa de garantía como instrumento aglutinante de contratos típicos o atípicos independientemente de sus particulares requisitos estructurales utilizando la técnica de la definición por categorías o reagrupamiento de contratos. Términos como anómala, omnibus o rotatividad de la garantía llegan a nosotros de la mano de Gabrielli, pero sobre todo, la estructura y el edificio creativo e interpretativo. La propuesta, la evolución, la solución.

Three decades ago, a seemingly simple book, written with the eloquence of legal language and a lexicon that only great masters are capable of, revolutionized the world of guarantee law, especially in the realm of movable property. New, vibrant, today we would say, disruptive. Brave and one that analyzed and broke old molds, stretching the seams of an institution as ancient and pivotal in law as the pledge. Not only in Italy but also in other countries, as countless academic experts - all of them scholars of guarantees - have attested in their first reviews or critiques of this monograph, and second, in the references, the calm and meticulous study of each part, each section, and each line of a book that is simply monumental. Furthermore, it is a work of the professor Gabrielli's youth, and today, thirty-three years after its first public appearance, it remains alive, fiercely alive. A book that, from the moment of its publication, was destined to become a classic among classics and a reference work. And there have been numerous and significant reforms that have arisen in the country beyond the Alps over the years concerning the pledge, notably in 2016 and 2020. It can be said - without fear of misunderstanding - that this book marks a turning point in how to approach, view, understand, and even imagine the pledge. A point that breaks the rigid structural and mental patterns, as well as the formal constraints that guarantees demanded in the rules. A book where, furthermore, there is a comprehensive analysis of the guarantee's cause as a unifying instrument for typical or atypical contracts, regardless of their specific structural requirements, using the technique of definition by categories or grouping of contracts. Terms like "anomalous," "omnibus," or "rotation of the guarantee" come to us through Gabrielli, but above all, the structure and the creative and interpretive building. The proposal, the evolution, the solution.
