La prolongada guerra del taxi: últimos capítulos jurisprudenciales y legales

Abstract

La reciente sentencia del Tribunal de Justicia de la Unión Europea resolviendo una cuestión prejudicial de interpretación planteada por el Tribunal Superior de Justicia de Cataluña en relación a la normativa interna nacional respecto de la regulación de las VTC en nuestro país abre un nuevo capítulo en la «guerra del taxi» contra esta nueva modalidad de movilidad urbana, despeja algunas de las dudas jurídicas existentes y plantea otras que no han quedado del todo aclaradas, lo que sigue generando incertidumbres regulatorias. Todo ello hace pensar que estamos abocados a que continúe el escenario de conflicto en que se ha movido el sector en los últimos años, máxime con las respuestas jurídicas que a la citada sentencia europea ha vuelto a dar el legislador estatal en el Real Decreto-Ley 5/2023. Trataremos de analizar la sentencia y los posibles efectos «pro futuro» que la misma podría generar.

The recent judgment of the Court of Justice of the European Union resolving a preliminary question of interpretation raised by the Superior Court of Justice of Catalonia in relation to the national internal regulations regarding the regulation of VTCs in our country opens a new chapter in the «taxi war» against this new form of urban mobility, clears up some of the existing legal doubts and raises others that have not been fully clarified, which continues to generate regulatory uncertainties. All this suggests that we are bound to continue the scenario of conflict in which the sector has moved in recent years, especially with the legal responses that the state legislator has once again given to the mentioned European ruling in the Decree 5/2023. We will try to analyze the sentence and the possible future effects that it could generate.
