dc.description.abstract | El 12 de abril, el Congreso de Ministros aprobó el Proyecto de Eficiencia Procesal para agilizar la justicia y contribuir a la sostenibilidad del sistema. Se destaca la inclusión de Medios Adecuados de Solución de Controversias (MASC) y reformas legales, con impacto potencial en la responsabilidad profesional sanitaria. En este contexto, los acuerdos extrajudiciales en responsabilidad sanitaria suelen llegar tarde e insatisfactoriamente. Se subraya la importancia de gestionar desde el inicio la reclamación y dialogar con el reclamante para el éxito de acuerdos extrajudiciales. El informe del Comité de Bioética sugiere un sistema no punitivo de notificación y registro de incidentes en salud, respaldado por MASC, para prevenir judicializaciones. El Proyecto de Eficiencia Procesal regula la implementación de MASC en asuntos civiles, incluyendo el sector salud. Se destaca la figura del experto independiente en responsabilidad sanitaria como un mecanismo eficaz. La implementación de MASC implica un cambio cultural, reconociendo la falibilidad humana y actuando proactivamente ante errores, evitando la judicialización y buscando soluciones transparentes y honestas. dc.description.abstract | On April 12, the Council of Ministers approved the Procedural Efficiency Project to expedite justice and contribute to the sustainability of the system. It highlights the inclusion of Alternative Dispute Resolution Methods (ADR) and legal reforms, potentially affecting professional healthcare liability procedures. In this context, extrajudicial agreements in healthcare liability often come late and unsatisfactorily. The importance of managing the claim from the outset and engaging in dialogue with the claimant for the success of extrajudicial agreements is emphasized. The Committee on Bioethics' report suggests a non-punitive system for reporting and registering health incidents, supported by ADR, to prevent litigation. The Procedural Efficiency Project regulates the implementation of ADR in civil matters, including the healthcare sector. The role of the independent expert in healthcare liability is highlighted as an effective mechanism. The implementation of ADR involves a cultural shift, recognizing human fallibility and proactively addressing errors, avoiding litigation, and seeking transparent and honest solutions.
