La carta medioambiental iberoamericana y el derecho de las generaciones futuras: ¿en ruta hacia el pacto verde iberoamericano?

Abstract

Este estudio se ha estructurado en siete apartados y al final se incluyen las conclusiones. En la primera parte se analiza la diversidad de sistemas que confluyen en el espacio regional iberoamericano. Se explica la conexión y vinculación entre ellos y las naciones de la región, con la finalidad de explicar el interesante y curioso entramado donde se despliegan las agendas políticas, sociales, económicas y ambientales. En la segunda parte se sitúa la investigación en el escenario de las Cumbres Iberoamericanas como germen de la agenda medioambiental iberoamericana y la diplomacia de la comunidad iberoamericana de naciones, que explica la decisión de aprobar una Carta medioambiental. La tercera parte desarrolla los contenidos fundamentales de la agenda medioambiental iberoamericana desde la gestación de la Carta medioambiental hasta los fundamentos y soportes de la misma. La cuarta parte se centra en el análisis de los contenidos de la Carta, partiendo de un estudio de su etiología y desarrollando los comentarios sobre sus principios, objetivos y ejes temáticos. La quinta parte aborda el tema de la transición ambiental y financiamiento verde, que es considerado en la Carta como imprescindible para lograr los diferentes objetivos en ella contenidos, haciendo referencia al contexto global de la comunidad internacional. La sexta y última parte aborda el tema de la equidad intergeneracional para desarrollar lo relativo al derecho de las generaciones futuras a un ambiente sano contenido en la Carta. Para ello se describe el derecho al ambiente en el contexto del sistema interamericano y posteriormente se analiza la evolución y contenido del derecho de las generaciones futuras.

This paper is structured in seven sections and concluding remarks are included at the end. The first part analyzes the diversity of systems that converge in the Ibero-American regional space. It explains the connection and linkage between them and the nations of the region, with the aim of explaining the interesting and curious framework where political, social, economic and environmental agendas unfold. The second part situates the research in the scenario of the Ibero-American Summits as the germ of the Ibero-American environmental agenda and the diplomacy of the Ibero-American community of nations, which explains the decision to approve an environmental Charter. The third part develops the fundamental contents of the Ibero-American environmental agenda from the gestation of the environmental Charter to its foundations and supports. The fourth part focuses on the analysis of the contents of the Charter, starting with a study of its etiology and developing comments on its principles, objectives and thematic axes. The fifth part deals with the issue of environmental transition and green financing, which is considered in the Charter as essential to achieve the different objectives contained therein, making reference to the global context of the international community. o this end, the right to the environment is described in the context of the Inter-American system, followed by an analysis of the evolution and content of the right of future generations.
