El interés superior del niño en la jurisprudencia sobre maternidad subrogada: una visión desde el Derecho Internacional Privado

Abstract

La existencia de relaciones claudicantes en la filiación -como resultado de las diferencias en la regulación de la maternidad subrogada en los Estados- afecta al derecho a la identidad de los niños y, por tanto, a su interés superior. Así lo ha entendido el Tribunal Europeo de Derechos Humanos. En este texto se analiza la influencia de la jurisprudencia de este Tribunal sobre el juego del interés superior del niño en los casos de maternidad subrogada, en las dos sentencias dictadas hasta el momento por el Tribunal Supremo español (sentencia de 6 de febrero de 2014 y sentencia de 31 de marzo de 2022).

The existence of claudicating relationships in filiation - as a result of differences in the regulation of surrogacy in the States - affects the right to identity of children and, therefore, their best interests. This has been the understanding of the European Court of Human Rights. This text analyses the influence of this Court's jurisprudence on the best interests of the child in cases of surrogacy, in the two judgments handed down so far by the Spanish Supreme Court (judgment of 6 February 2014 and judgment of 31 March 2022).
