Litigios climáticos en perspectiva de derechos humanos. una aproximación a su desarrollo en Europa y América Latina

Abstract

Esta investigación tiene por objeto una aproximación a este importante y novedoso aspecto de la justicia ambiental ante la crisis climática, con especial interés sobre los derechos humanos y más en concreto de los derechos de las generaciones futuras. Se aspira a una aproximación al estado de los litigios climáticos tanto en Europa como en América Latina, a través de los casos más destacados o emblemáticos que ya han sido decididos judicialmente o que están en curso. Y detectar las tendencias al respecto. Se abordan temas clave del momento actual: el cambio climático, los derechos humanos y la herramienta del litigio climático para determinar el combate desde esa perspectiva de derechos humanos frente a la gravísima crisis climática que afecta a la humanidad.

This research aims to approach this important and novel aspect of environmental justice in the face of the climate crisis, with a special interest in human rights and more specifically in the rights of future generations. The aim is to approach the state of climate litigation both in Europe and Latin America, through the most prominent or emblematic cases that have already been judicially decided or are ongoing. And to detect trends in this regard. Key issues of the present time are addressed: climate change, human rights and the tool of climate litigation to determine the fight from that human rights perspective against the very serious climate crisis affecting humanity.
