La emoción del miedo desde el caleidoscopio jurídico

Abstract

Se estudia el miedo en relación con la Política y, especialmente, con el Derecho. Se comienza reparando en el miedo como emoción y, más concretamente, en la naturaleza y en los aspectos de las emociones, en general, y del miedo, en particular. A continuación, se focaliza en el miedo como emoción política y jurídica que desemboca en el poder del miedo. Las huellas del miedo pueden apreciarse en la Filosofía del Derecho, en el principio de precaución y a propósito del mito de la seguridad jurídica. El tratamiento del miedo en los diferentes ámbitos –Civil, Penal, (Contencioso-)Administrativo y Social– del ordenamiento jurídico español precede al apartado final de carácter pretendidamente conclusivo.

Fear is studied in relation to politics and, specially to law. It begins by looking at fear as an emotion and, more specifically, at the nature and aspects of emotions in general and fear in particular. It then focuses on fear as a political and legal emotion that leads to the power of fear. The traces of fear can be seen in the philosophy of law, in the precautionary principle and in the myth of legal security. The treatment of fear in the different spheres –Civil, Criminal, (Contentious-)Administrative and Social– of the Spanish legal system precedes the final section, which is intended to be conclusive.
