La ricerca de la verità, ratio e telos del processo canonico di nullità del matrimonio

Abstract

La búsqueda de la verdad constituye el principio directivo del proceso para evaluar la nulidad del matrimonio. Inspirado en el pensamiento y la contribución de Llobell, el artículo analiza la profunda influencia (ontológica y antropológica) de la cuestión de la verdad en el contexto procesal. En la concepción institucional del proceso, la unidad de acción guía toda la operatividad de los sujetos involucrados, particularmente el juez, las partes y sus respectivos abogados. Las declaraciones de las partes, incluso a la luz de la reformulación del can. 1678 § 1 MIDI, deben ser evaluadas según un criterio de sano realismo jurídico. La búsqueda de la verdad en la parte investigativa del proceso encuentra su reflejo en la certeza moral del juez. El cumplimiento de la justicia en el proceso nunca puede prescindir de la verdad, y la reforma procesal debe ser interpretada en términos de una integración recíproca y continuidad con la tradición canónica.

The search for truth constitutes the directive principle of the process for assessing the nullity of marriage. Inspired by the thought and the contribution of Llobell, the article analyzes the profound (ontological and anthropological) influence of the issue of truth in the procedural context. In the institutional conception of the process, the unity of action guides the whole operativity of the included subjects, particularly the judge, the parties, and their respective advocates. The declarations of the parties, even in light of the reformulation of can. 1678 § 1 MIDI, must be evaluated according to a criterium of healthy juridical realism. The search for truth in the investigatory part of the process finds its reflection in the moral certitude of the judge. The fulfillment of justice in the process may never prescind from truth, and the procedural reform must be interpreted in terms of a reciprocal integration and continuity with the canonical tradition.
