La demanda judicial canónica

Abstract

El proceso canónico se constituye como un instrumento im­ prescindible que, con carácter instrumental, viene a posibilitar la defensa de las posiciones jurídicas (de los propios derechos), pu­ diendo concretar el derecho a la tutela judicial efectiva que reco­ noce el can. 221 a todo fiel. Pues bien, en este «vehículo de ver­ dad» en que se convierte el proceso, la demanda viene a tener una especial relevancia, pues viene a ser el cauce por el que se accede al proceso y, por medio de este, a una sentencia justa, y también, en sentido contrario, puede convertirse - si existe una defectuosa valoración - en un cauce que imposibilita el derecho a la tutela judicial efectiva. En este marco se sitúa el volumen que venimos a comentar.

In this "vehicle of truth" that the process becomes, the petition holds particular significance, as it serves as the pathway through which access to the process is achieved and, through it, to a just judgment. Conversely, it can also become—if there is a flawed evaluation—a pathway that hinders the right to effective judicial protection. Within this framework lies the volume we are about to discuss.
