Mutual trust as a driver of integration: which way forward?

Abstract

El capítulo "La confianza mutua como motor de la integración: ¿Qué camino seguir?" de Cristina Sáenz Pérez examina el concepto jurídico de confianza mutua en el Espacio de Libertad, Seguridad y Justicia (ELSJ) de la Unión Europea, especialmente en la cooperación judicial. El capítulo explora si la confianza mutua puede considerarse un Principio General del Derecho de la UE (GPEU), analizando su base jurídica, funciones y limitaciones, en particular su interacción con los derechos fundamentales. Identifica un cambio en el enfoque del TJUE, que ha pasado de considerar la confianza mutua como una presunción irrefutable a un principio sujeto a límites, especialmente a la luz de las deficiencias sistémicas de los Estados miembros. En última instancia, el capítulo sostiene que, a menos que se armonicen más las protecciones de los derechos fundamentales, la confianza mutua puede perder su papel fundacional en la integración de la UE.

The chapter “Mutual Trust as a Driver of Integration: Which Way Forward?” by Cristina Sáenz Pérez examines the legal concept of mutual trust within the European Union’s Area of Freedom, Security and Justice (AFSJ), especially in judicial cooperation. The chapter explores whether mutual trust can be considered a General Principle of EU Law (GPEU), analyzing its legal basis, functions, and limitations—particularly its interaction with fundamental rights. It identifies a shift in the CJEU's approach from treating mutual trust as an irrebuttable presumption to a principle subject to limits, especially in light of systemic deficiencies in Member States. Ultimately, the chapter argues that unless fundamental rights protections are further harmonized, mutual trust may lose its foundational role in EU integration.
