Fresh start o discharge como medio de regeneración
Resumen
El objeto del presente trabajo es la descripción y delimitación del régimen de liberación
de deudas o fresh start como solución a la insolvencia física. En el se analiza como el
legislador atiende a la llamada de atención acerca de las injusticias que provoca el
principio de responsabilidad patrimonial universal consagrado en el artículo 1.911 de
Código Civil, a través de la Ley de Emprendedores, ley 14/2013, de 27 de septiembre,
de apoyo a los emprendedores y su internacionalización. Sobre dicha ley se realizará un
análisis en profundidad, valorando las modificaciones que introduce en la Ley
Concursal y sus efectos, también se describe la internacionalización y su relevancia
actual. Se concluye calificando positivamente al legislador por haber regulado el
régimen de liberación de deudas, pero se le crítica por no haber regulado con
profundidad y precisión este régimen. The aim of the present work is the description and delimitation of the regime of
liberation of debts or fresh start as a solution to the physical insolvency. It analyzes
how the legislator attends to the call of attention about the injustices derived from the
principle of universal patrimony established in the civil code, section 1.911, through
the ‘Entrepreneurial Law’ law 14/2013, on the 27th of Sepetember, which supports the
entrepreneurs and their internationalization. This law will be submitted to a deep
analysis, watching the modifications which introduces in the ‘Act on Insolvency’(‘Ley
Concursal’) and their effects, it also describes the internationalization and its current
relevance. As a conclusion, the legislator has been assessed positively due to the fact of
having regulated the regime of liberation of debts, although he has also been criticized
because of not having regulated this regime in depth and accuracy.
