Abstract

The article compares migration-control and asylum-management externalization models implemented by Spain, the United Kingdom, and the United States. Drawing on legislation, case law, public policies, human-rights materials, and secondary data, it examines Spain’s agreements with African countries, the United Kingdom’s Rwanda asylum scheme, and United States cooperation with Mexico, including the Migrant Protection Protocols. The authors argue that these practices geographically, legally, and morally displace the responsibility of receiving states, restrict effective access to asylum, and may violate the principle of non-refoulement. The study also considers the limitations of judicial review when courts assess restrictive migration policies and executive action. It concludes by recommending reduced reliance on externalized enforcement, greater transparency and accountability, expanded safe and lawful migration pathways, and stronger protection of migrants’ dignity and fundamental rights.
