La desamortización de Madoz

Abstract

Tras el pronunciamiento del General O’Donnell de junio de 1854 en Vicálvaro y la posterior convocatoria a Cortes Constituyentes, el nuevo Gobierno de Baldomero Espartero y las nuevas Cortes encontraron una encrucijada política y económica. Por un lado, se presentaba la oportunidad de gran una reforma política mediante una nueva constitución liberal. Por otro, la deplorable situación de la deuda y el déficit presupuestario ahogaban al gobierno. Es por esto por lo que Pascual Madoz nombrado ministro de Hacienda para liderar una nueva desamortización que aliviase la situación económica del estado y acelerase la instauración de un modelo nuevo liberal de la propiedad. Durante el debate de este nuevo proyecto desamortizador se discutiría no solo sobre una mera operación de crédito, sino que se viviría un enfrentamiento, en vía parlamentaria, entre el antiguo y el nuevo régimen. El futuro de los bienes de propios y de los eclesiásticos, las relaciones con la Santa Sede, el combate contra la deuda estructural, la necesidad de modernización serían algunos de los asuntos que habían de abordarse en el proceso legislativo. El objeto de este trabajo será analizar la tramitación parlamentaria de la que había de convertirse en la Ley 1 de mayo de 1855.
In the wake of General O’Donnell’s declaration in June 1854 in Vicálvaro and the subsequent convening of the Constituent Cortes, the new government of Baldomero Espartero and the new Cortes found themselves at a political and economic crossroads. On the one hand, there was an opportunity to carry out a major political reform through a new liberal constitution. On the other hand, the dire state of the debt and the budget deficit were suffocating the government. This is why Pascual Madoz was appointed Minister of Finance to lead a new confiscation of church lands that would alleviate the state’s economic situation and accelerate the establishment of a new liberal model of property ownership. During the debate on this new confiscation project, the discussion would not be limited to a mere credit operation; rather, a confrontation would unfold in the parliamentary arena between the old and the new regimes. The future of the municipal and ecclesiastical property, relations with the Holy See, the fight against structural debt, and the need for modernization were some of the issues to be addressed in the legislative process. The purpose of this study is to analyze the parliamentary proceedings leading up to what would become the Law of May 1, 1855.
