És un dret conèixer l’origen biològic?

Abstract

El artículo analiza el debate bioético y jurídico sobre si las personas nacidas mediante técnicas de reproducción humana asistida tienen derecho a conocer su origen biológico. A partir del informe emitido por el Comité de Bioética de España en 2020, el autor expone el conflicto entre el derecho a la identidad del nacido y la protección del anonimato del donante. El texto sostiene que la solución tradicional basada en el anonimato resulta cada vez menos defendible a la luz de la Convención sobre los Derechos del Niño y de la evolución normativa observada en Europa. Asimismo, cuestiona los argumentos utilitaristas que justifican mantener el anonimato y defiende que el acceso al origen biológico no debería entenderse como una amenaza para la reproducción asistida.

This article examines the bioethical and legal debate on whether people born through assisted human reproduction techniques have the right to know their biological origin. Drawing on the report issued by the Spanish Bioethics Committee in 2020, the author presents the conflict between the child’s right to identity and the protection of donor anonymity. The text argues that the traditional solution based on anonymity is increasingly difficult to defend in light of the Convention on the Rights of the Child and the normative changes taking place in Europe. It also questions the utilitarian arguments used to preserve anonymity and maintains that access to biological origin should not be understood as a threat to assisted reproduction itself.
